OCONTO – The state’s investigation of the shooting death of a Suring man by Oconto County deputies last month is nearly complete, according to District Attorney Edward Burke.
Burke told the county’s Law Enforcement/Judiciary Committee on Wednesday he expects to be receiving reports from the state Division of Criminal Investigation by the end of the week.
After meeting with the DCI agents in charge of the probe and reviewing the reports, Burke will determine whether the shooting of Jacob Bubb was justified.
“Hopefully, I will have something to the public within the next week or two, depending on what (else) is going on,” he said.
Burke said DCI, which handles many investigations of officer-involved shootings in Wisconsin, "put a big team together to do this because we want to be ... accountable to the public."
The state has so far released only basic details of the incident to the public and to Burke, who said initial indications are that investigators have not found "red flags" in the shooting of Bubb.
The shooting happened May 17 after Sgt. Ben Schindel and Deputy Kevin Christensen responded to a report that Bubb, who was wanted on felony warrants, could be found in a home about 8 miles northeast of Suring.
After receiving consent to search the home in the 11000 block of County Z, the officers found Bubb, who had a firearm, the state DCI previously said.
Deputies shot Bubb during the incident and he died at the scene. No officers or anyone else was injured.
DCI did not say if anyone else was present, or whether Bubb fired his weapon.
“A young man unfortunately lost his life,” Burke told the panel. “It’s never happened since I’ve been here.”
Schindel and Christensen, who have been with the sheriff’s office for four years and three years, respectively, were placed on administrative duty. Christensen is one of the departments’ police dog handlers.
Sheriff Todd Skarban told the committee that he would like to get both men back to work as soon as possible.
Skarben said he’s kept in close contact with them since the incident. Asked after the meeting how they were doing, Skarben said “it’s been difficult,” but noted they have taken advantage of the county’s employee assistance program as well as counseling.
“That would have been required, but they wanted to go,” he said.
Skarben also told the committee his office will still be doing an administrative review of the shooting as well as a civil liability investigation.
Bench warrants for Bubb’s arrest were issued after he failed to show up for court appearances on Feb. 13, according to online court records.
He was charged April 20, 2019, with a felony county of substantial battery-use of a dangerous weapon, criminal damage to property and disorderly conduct — all as a repeat offender. The criminal complaint alleged he punched another man while wearing brass knuckles and broke the taillight of a vehicle. The victim required 10 stitches.
Bubb had also been charged March 5, 2019, with carrying a concealed weapon, possession of a firearm while intoxicated and possession of drug paraphernalia — all as a repeat offender — over an incident Feb. 6 in the city of Oconto Falls.
Court records show Bubb lived about 5 miles north of Suring, about 6 miles west of where the shooting occurred.
