A suspended police officer has been convicted and must be of good behaviour for 18 months after he was found guilty of grabbing his colleague's breast following a Christmas party in Sydney's CBD.
Ronald John Tarlington, 50, who has been a police officer for more than two decades, attended a party at The Rocks on December 5, 2018, then went to another pub afterwards with several colleagues.
About 10pm, a female colleague was sitting on Tarlington's lap when he moved his right hand into her unbuttoned jacket and grabbed her breast, causing her to stand up and walk away. The interaction was captured on CCTV.
Last year, magistrate Paul Mulroney found Tarlington guilty of sexually touching another person without consent. He found the officer touched the woman "squarely on the breast area" and intentionally squeezed her nipple for a sexual purpose.
Mr Mulroney said there was no evidence consistent with the touch being a mistake, or the woman being mistaken by Tarlington's behaviour.
The woman told the court that Tarlington squeezed her nipple, growled and had a crooked smile on his face. She told several colleagues immediately afterwards, including telling one: "Tarlo touched me ... he grabbed my boob and had my nipple in his fingers."
The colleagues said in statements that the woman was distressed and angry afterwards.
On Monday, Mr Mulroney said any person should be able to socialise without having their bodily integrity compromised. He said that an added insult was that Tarlington should have been someone the woman could trust.
Mr Mulroney acknowledged that Tarlington had been ostracised after the offence and said he would be surprised if the officer did something similar again.
He convicted Tarlington and sentenced him to an 18-month conditional release order, which has a standard condition that a person must not commit any further offence. An apprehended violence order was also made.
Tarlington has filed an appeal. He did not speak to waiting journalists as he left court.
A NSW Police spokesperson confirmed on Monday that Tarlington, who holds the rank of Sergeant, remains suspended.
