Elderly advisor charged with assault, sued by colleague he allegedly shot - Citywire USA

A 90-year-old financial advisor has been charged with assault and battery with a deadly weapon, nearly two weeks after his arrest for the alleged shooting of a co-worker. 

The advisor, Leonard Bernstein, was arrested June 30, the same day Oklahoma City police say he shot his former colleague Christopher Bayouth, 61, multiple times at a Morgan Stanley office in the city. Bayouth was later transported to OU Medical Center.

In an affidavit, police said they tied a .38-caliber handgun that was in Bernstein’s possession to shell casings found at the scene. He was arrested shortly after the shooting and later released on $50,000 bail.

Felony charges for one count of assault and battery with a deadly weapon were filed by the district attorney on July 11, the Oklahoma County district court confirmed. A hearing date has not been listed. 

The charge filed against Bernstein pertains to those who use a gun or other weapon ‘with intent to injure any person, although without the intent to kill such person,’ and carries a maximum sentence of 10 years in state prison, per Oklahoma law. 

Bernstein, a 28-year industry veteran who rejoined Morgan Stanley last year after a hiatus with the company, was business partners with Bayouth, a witness told police. He had apparently transferred his accounts to his alleged victim.

While exact circumstances leading to the shooting are unclear, observers have raised questions about Bernstein’s health. 

Bernstein was fired by Morgan Stanley the day after the shooting. An attorney listed for Bernstein has not returned a request for comment. 

Oklahoma County has granted both Morgan Stanley and Bayouth restraining orders against Bernstein. Bayouth received surgery in the hospital, and had not yet been released as of the afternoon of July 12, his attorney confirmed in an email. 

A separate civil lawsuit, requesting monetary damages for assault and battery, has been filed by Bayouth. In the suit, Bayouth claims that Bernstein ‘acted with the intent of killing’ him. He also said his medical bills to date have totaled $200,000.
