WASHINGTON, D.C. - A former U.S. House of Representatives colleague wants Housing and Urban Development Secretary Marcia Fudge to use her “executive discretion” to not enforce the federal prohibition against marijuana use in federally assisted housing in jurisdictions where it’s legal.
Because marijuana is illegal under federal law, current HUD policies bar its users from federally assisted housing, and landlords are allowed to evict residents from federally assisted housing for using it.
Washington D.C.’s non-voting member of Congress, Del. Eleanor Holmes Norton, sent Fudge a letter last week that observes adult use of marijuana and/or medical marijuana is legal in 36 states and the District of Columbia, and over 90% of Americans back legalized medical marijuana.
Norton’s letter says that Congress has blocked the U.S. Department of Justice from using federal money to keep local jurisdictions from implementing their medical marijuana laws, and argues HUD should follow suit by not enforcing the federal marijuana prohibition in states that have legalized marijuana.
“Smoking marijuana in federally assisted housing should be treated in the same manner as smoking tobacco in federally assisted housing,” said her letter to Fudge.
A HUD press representative said the agency has received Norton’s letter and is preparing a response.
During her years representing Northeast Ohio in the U.S. House of Representatives, Fudge cosponsored legislation to decriminalize marijuana, to allow banks to serve cannabis businesses in states where it’s legal, as well as a resolution calling for an end to the “War on Drugs” and issuance of an apology to those it harmed.
Fudge did not cosponsor legislation Norton introduced in 2019 that would have blocked HUD from from barring or discouraging marijuana use in federally assisted housing if its use complies with laws in the state where the housing is located. The pair collaborated on unrelated legislation last year that would have designated the District of Columbia’s mayor as its governor as a step toward making it the 51st state.
