Everett city councilors pressure their first Black female colleague to resign - The Boston Globe

Gerly Adrien smiled during her swearing-in ceremony in January. She is the first black woman ever elected to Everett's city council.Matthew J. Lee/Globe Staff

Several city councilors in Everett, one of the Massachusetts cities hit hardest by the coronavirus, told their only Black colleague last week that if she is not willing to attend council meetings in person, she should resign.

Councilor Gerly Adrien has been participating in council meetings via Zoom because she is concerned about exposing a vulnerable family member to the virus. But at last Monday night’s meeting, she initially couldn’t be heard in the council chamber due to problems with the city’s equipment. Some of her colleagues, frustrated, demanded that she attend in person like they do, according to Adrien and local news reports.

Adrien, who became the first Black woman ever elected in Everett when she topped the ticket of at-large councilors last November, said she has no intention of resigning and attributed the request to “prejudice and microaggression.”

“If I can still vote, if I can still participate, why is that such a concern?” said Adrien, who has frequently come in for criticism from other councilors. “Everything I do is an issue.”

Adrien, 31, is at least three decades younger than some of her colleagues, and has often ruffled feathers by challenging traditions and asking pointed questions. “She’s been disrespectful to me since Day One,” Council President Rosa DiFlorio told the Globe in June. “She has no respect for seniors or white people.”

Video of the councilors' comments at last week’s meeting has disappeared. The morning after, the city discovered the video of the session had been erased from its broadcasting system, said Deanna Deveney, director of communications for the city of Everett.

Mayor Carlo DeMaria said he instructed his staff to immediately notify city and state police, as well as the Middlesex District Attorney’s office, which confirmed it has launched a criminal inquiry into the video’s disappearance.

“I am totally outraged that someone, somehow gained access to the City of Everett’s server,” DeMaria said in a statement.

The city of Everett has been one of the hot spots of coronavirus cases throughout the pandemic and is currently designated a high-risk community. Its average daily rate of infection per 100,000 residents was 24.4 over the last two weeks — higher than Boston and all but 10 other Massachusetts communities, according to Massachusetts Department of Public Health data. Black Americans face two to three times the risk of coronavirus infection as white Americans and are more than twice as likely as white Americans to die from COVID-19, data from the Centers for Disease Control and Prevention show.

Adrien said she’s leery about sitting in the council chamber, where most members don’t wear masks, for meetings that can last up to four hours. She and her husband live with her father, who is especially vulnerable because he has diabetes. She has a doctor’s note saying it is ill-advised for her to attend.

Everett city councilors, like most municipal boards, met online for months after Governor Charlie Baker issued an executive order allowing public meetings to be conducted remotely during the pandemic. Technology was always problematic, though, and Zoom meetings brought the potential for gaffes to be streamed directly from politicians' homes into those of voters.

At a July council meeting, one councilor seemed to be applying lotion to his arms, getting ready for bed, and turning out the light. Another councilor expressed his eagerness to resume meetings in City Hall, but DiFlorio said she couldn’t push members beyond their comfort level.

“Unfortunately, until this COVID is over, if people decide that they want to stay on Zoom, we are unable to tell them that they have to come off,” DiFlorio said at the July meeting, according to a video posted on the city’s website.

But the council resumed meeting in City Hall in September, and last week, DiFlorio was among those voicing dissatisfaction with Adrien’s level of participation.

“We need to go back to the old-fashioned way,” the Everett Independent quoted DiFlorio as saying. “If the Internet goes off, then come on. We have a job to do. To the extent an individual does not want to be here, that’s their decision.”

Councilor Peter A. Napolitano went further, directly challenging Adrien to resign and contrasting her commitment with that of her peers.

“There are four or five members in the chamber over 60,” Napolitano said, according to the Independent. “We’re here because we took an oath to the residents of Everett. If you can’t do it, you have some decisions to make.”

Neither DiFlorio nor Napolitano returned phone calls from the Globe. DeMaria said in a statement that emotions and anxieties are running high during this unprecedented time, but, he said, “I’m hopeful that all members of the Council can put aside whatever differences they may be facing as we continue collaborating for the better of our City.”

In June, amid a national reckoning on race relations, Adrien proposed a committee council on race relations; other council members turned on her, with some denying the existence of racism in their city.

The communications gap widened at last Monday’s meeting due to an audio glitch that prevented Adrien from being heard in the chamber during the first part of the meeting. A city employee listening to her on his laptop had to relay her votes and questions to the councilors, who blamed her for the snag. On Friday, the city acknowledged the problem was its own.

“The amplifier broke that evening,” Deveney said on Friday. “We could not hear her through the speaker system. It is being fixed.”

Viewers watching on Everett Cable TV could hear Adrien’s input from Zoom, although her colleagues in the city council chamber could not.

Adrien further irritated some of the other councilors by saying she had not seen a document because it had not been e-mailed to her as requested; DiFlorio asserted that councilors' packets are dropped off at their houses and that scanning documents would cost money. Adrien offered to teach city staff how to scan documents. DiFlorio, who could see Adrien online, but still could not hear her, deemed her “out of control,” according to the Independent.

Watching from home, Everett resident Joan Beckta was outraged. Though she said Adrien often rolls her eyes at her colleagues, which gets under their skin, Beckta viewed DiFlorio as the one being disrespectful and dismissive of her health concerns. A 68-year-old paralegal, Beckta said she texted DiFlorio during the meeting, she said, calling it “ridiculous” that councilors couldn’t effectively use technology.

“Technology exists to make it possible for her to attend the meetings remotely,” Beckta said. “It’s not her fault if they do not keep their technology up to date. There is no good reason why she can’t attend the meetings remotely.”

Adrien doesn’t think the dispute is about technology at all.

“I think they’re just sick and tired of me being on the council,” she said. “And they just want me out.”

University officer accused of pointing gun at another officer - Insider - INSIDER

nnnindonesia.blogspot.com
  • A university officer is accused of pointing his gun at his colleague on the job after an argument over face mask guidelines on campus, according to a report by KABC-TV.
  • The officers worked at California State University San Bernardino, KABC-TV reported.
  • The officer who pulled out his firearm— who is a sergeant according to the victim's lawyer— said the conversation over face masks "led to the sergeant losing his temper, and ultimately pulling a gun on my client," Tristan Pelayes told KABC-TV.
  • Visit Insider's homepage for more stories.

A university officer is accused of pointing his firearm at his colleague during an argument about enforcing coronavirus facemask practices on campus grounds, according to local news.

The unidentified officers involved were California State University San Bernardino police, according to KABC-TV

The situation, which occurred on September 15, was captured on video and resulted in the university and  San Bernardino police launching an investigation into what happened, the news station reported.

"We are aware of the incident and an internal investigation is ongoing. Thus, we have no further comment at this time," a rep for California State University San Bernardino told KABC-TV.

Video of the incident posted by KABC-TV's Rob McMillan on Twitter shows one officer pointing his gun at his coworker for a brief moment and putting it away. KABC-TV reported the accused officer is a sergeant, according to Tristan Pelayes, a lawyer for the victim officer.

Pelayes said the incident happened over dialogue from the accused sergeant about enforcing the proper face mask guidelines on campus, according to KABC-TV.

"My client questioned the authority for that. For instance, if we were to arrest somebody or escort somebody off the campus, what is our legal authority for that?" Pelayes told KABC-TV. "Apparently, that conversation led to the sergeant losing his temper, and ultimately pulling a gun on my client."

Pelayes said that the officer reported the incident to the San Bernardino police department which is being investigated "as a misdemeanor charge", according to a department spokesperson, KABC-TV reported.

GALESVILLE, Wis (WKBT) – A new performing arts center for the G-E-T School district is almost complete.

Crews broke ground on the highly anticipated project last November following 18 months of researching and planning.

The new performing arts center will include seating for 700 people, a ticket box office, multiple dressing rooms, and dedicated storage.

The first event to take place will be the National Honor Society Induction Ceremony, which will be held for students only.

“It’s hard to appreciate the size of everything on paper. but the lobby is beautiful, the aesthetics of the walls are phenomenal, the sound quality is amazing. It’s really a state of the art project we built,” said Matt Wenthe, the business manager for the project.

Students participating in band and choir will also be able to use the new space to help with social distancing.

Ziyech and Kante 9/10 as Chelsea complete convincing win at Burnley - ESPN

Frank Lampard praises ‘complete performance’ as Chelsea ease past Burnley - Yahoo Sports

nnnindonesia.blogspot.com

Frank Lampard felt his Chelsea side took “a nice step forward” as they made light work of Burnley with a 3-0 win at Turf Moor.

The Blues followed up their 4-0 thrashing of FC Krasnodar in midweek with another clean sheet and another productive day in front of goal, as Hakim Ziyech, Kurt Zouma and Timo Werner all found the target in a confident display.

There were also fine displays on either flank from Ben Chilwell and Reece James, who helped add to both the attacking verve and defensive shape of a team on the up.

Hakim Ziyech, right, played an important part on his full debut (Alex Pantling/PA)

Lampard’s summer spending spree looks to be paying off as his combinations settle into their work and, although he was quick to point out there is plenty of work still to do, he cut a satisfied figure at the end of the game.

“It was a complete performance,” he said.

“This feels like a nice step forward. We’re nowhere near the end of the road but it was a really good display and a solid one too. Certainly, we have a nice bit of momentum.

“We brought players in who didn’t have a pre-season so we knew we couldn’t throw everything in the air and have it all land perfectly. But clean sheets are a great sign of the spine in the team.

“When you’re keeping clean sheets and scoring goals you know you’re going in the right direction. I’m not going to jump up and down after a win, but I really enjoyed that performance. We were much more positive in our style of forward passing and that’s all part of the process.”

As for Ziyech, who scored in Russia on his first start for the club and followed up on his first Premier League start with a goal and an assist for Werner, Lampard was suitably enthused.

“I expected a lot of him because I’m aware of his quality, but what we’ve seen since he’s been here is his personality,” he said.

“He gives us a big boost with his demeanour and he’s had two goals in two games in just a few days, it’s a really good start for him.”

Werner owed his starting berth to Christian Pulisic’s injury in the warm-up, with Lampard revealing the forward experienced “a small sensation in his hamstring”. He will now be sent for scans to assess the problem.

It was another difficult afternoon for Burnley boss Sean Dyche (Alex Pantling/PA)

For Burnley boss Sean Dyche it was another trying day at the office. His side are rooted at the wrong end of the table with just one point from their first six outings, with issues to address at both ends of the field.

Dyche admitted to being outclassed by the opposition on this occasion but was aggrieved by the decision not award a penalty when Edouard Mendy bundled through Ashley Barnes a few moments after the striker had shot over from a great position.

“The best side won, so that is about right,” he said. “But I am confused about penalties now. I don’t know what is a penalty and what isn’t. People get touched on the shoulder, their legs buckle and it’s a penalty.

“He (Barnes) gets felled pretty harshly but it’s not a penalty. I’m pretty confused. If that’s in the middle of the pitch it’s a foul, 100 per cent.

“I’m not remotely suggesting if we get the penalty we win the game, just to be clear, but you still want to have it.”

Military Veteran First to Complete DMACC's Subaru-U Program - kwbg.com

nnnindonesia.blogspot.com

ANKENY, Iowa—A military veteran persevered through a pandemic and his wife accepting a job out-of-state to complete his DMACC Automotive Technology Associate Degree and go on to become the first DMACC Subaru-U graduate.

Jared Szczepanski said when he was nearing the end of his enlistment with the U.S. Air Force, he was looking for opportunities in the automotive industry.

He said everywhere he looked pointed him to DMACC with their numerous programs and outstanding testimonials.

“As an active-duty service member transitioning to the civilian workforce, the DMACC Automotive program and staff made this normally stressful process easy and enjoyable,” Szczepanski said.  “The amount of resources and material given to me was more than enough to ensure my start in the program would be successful and rewarding.”

Szczepanski said he always had a passion for Subaru engineering and heritage and was excited to get the ball rolling when first told about the Subaru-U offering at DMACC.

This unique partnership between Subaru and DMACC allows students to learn and receive specific training related towards Subaru vehicles.

“Students who choose to work at a Subaru dealership after completing the DMACC Automotive Technology program will leave with Subaru certifications,” said DMACC Automotive Programs Chair Jerry Burns. “When they graduate from Subaru-U, they will possess the required skills needed to be an entry-level technician and be able to work on today’s technology-advanced Subaru vehicles.”

Szczepanski said he then started completing the Subaru on-line courses alongside his in-person classes at DMACC.

“The online Subaru courses actually complimented the Automotive Mechanics Technology courses quite well, and I was able to bring my questions and understandings from the Subaru courses into class and get further perspective from my DMACC instructors,” Szczepanski said.

Szczepanski’s wife accepted at job at Northern Arizona University in Flagstaff, AZ in June of 2019.  Szczepanski said he then started looking for potential career opportunities in the area.  While in the middle of both his DMACC Automotive Technology courses and Subaru-U courses, he reached out to Flagstaff Subaru owner Trent Olson who encouraged Szczepanski to keep him updated with his progress.

When the COVID-19 pandemic forced DMACC to transition to online learning, Szczepanski said he decided to head down to Arizona to be with his wife instead of attending online lectures from his one-bedroom apartment in Ankeny.

He said when DMACC automotive instructors Jeff Calkin and Shane Boots were able to get back into the lab for hands-on training, he immediately flew back to Iowa to get a better grasp on the advanced material through in-person learning.

“With the pandemic in full effect, I was not able to participate in the Subaru internship at all, but I was still able to obtain my Associate Degree,” Szczepanski said.

After graduating from DMACC’s Automotive Technology program and completing all of his Level I and Level II Subaru-U online courses, Szczepanski said he again contacted Flagstaff Subaru Owner Trent Olson.  Olson, along with Service Manager Mike Labunetz, conducted an over-the-phone interview with Szczepanski.

”After all was said and done, Olson decided to take a chance on me, knowing I had zero ‘real-world’ shop experience,” Szczepanski said.

He then packed his tool box and belongings in a 15-foot U-Haul and moved down to Arizona to be with his wife and hopefully start his new career.

“Service Manager Mike Labunetz moved me into my new work bay and immediately gave me repair orders. With my DMACC acquired knowledge along with Subaru-U training, I was able to complete the majority of my repair orders with little to no assistance from fellow technicians,” Szczepanski said.  “I was able to completely shatter my 90 day expectations within the first two weeks.”

He said he is now into his third month of employment at Flagstaff Subaru and is on the absolute fastest track for becoming Senior Master Subaru Certified.

“Not a day goes by where I do not apply the knowledge gained from my DMACC program, and I know I would not be where I am today without it,” Szczepanski said. “DMACC has truly given me every tool I need to succeed, from knowledgeable instructors, modern equipment and real-world facilities.”

In addition to the new Subaru-U program, the DMACC Automotive Technology program has manufacturer partnerships with General Motors for the GM Automotive Service Education Program (ASEP), Ford with the Ford Automotive Student Service Educational Training (ASSET) program, Fiat Chrysler with the College Automotive Program (CAP) and Honda with Honda Professional Automotive Career Training (PACT).

Match #1: FC Dallas vs. Houston Dynamo

WHO WILL WIN?
DAL win Draw HOU win
30 points 40 points 40 points
Predict the action: Halftime score (30 points - both teams, 10 points - one team)
  • There's historically little that separates the Texas rivals, since their all-time league meetings are split with a 12W-12L-14D record. Even this year, they're 1W-1L-1D against each other.
  • The odds might favor FC Dallas, since they've lost only one of their last 22 home matches. Meanwhile, Houston have won only two of their last 25 away matches.
  • Houston face long odds to make the playoffs, while FC Dallas are currently in sixth place in the Western Conference.
  • All-time Series: Tied at 12W - 12L - 14D; DAL 58 goals scored, HOU 54 goals scored
  • Kickoff: Saturday, October 31 at 3:30 pm ET
  • Watch on: Univision, TUDN, Twitter in US; MLS LIVE on DAZN in Canada

Match #2: Columbus Crew SC vs. Philadelphia Union

WHO WILL WIN?
CLB win Draw PHI win
30 points 40 points 40 points
Predict the action: Full time score (30 points - both teams, 10 points - one team)
  • While Philadelphia are closing in on the Supporters' Shield, they've taken one point from their last five trips to Columbus and failed to score in any of those games.
  • Columbus will need to tighten up defensively, having failed to post a shutout in eight straight matches. Even still, they've allowed a league-low 17 goals this season.
  • Key injuries could shape this match, with Columbus coping without striker Gyasi Zardes and Union goalkeeper Andre Blake suffering a right-hand fracture midweek.
  • All-time Series: CLB lead 14W - 9L - 3D; CLB 35 goals scored, PHI 34 goals scored
  • Kickoff: Sunday, November 1 at 3:30 pm ET
  • Watch on: ABC in US; TSN in Canada

Match #3: New York City FC vs. New York Red Bulls

WHO WILL WIN?
NYC win Draw RBNY win
20 points 40 points 40 points
Predict the action: First club to score (10 points)
  • The Red Bulls have made a habit of scoring late, with Aaron Long nabbing an 89th-minute game-winner in last weekend's 1-0 win over the New England Revolution. Before then, it was a pair of stoppage-time equalizers from Brian White.
  • While his MLS career has been inconsistent, NYCFC midfielder Jesus Medina has scored in each of his last two NYCFC games. The last Cityzens attacker to score in three straight matches was Heber during the 2019 campaign.
  • Looking at the rivalry, NYCFC have won four of the past five contests at Yankee Stadium after losing the first two meetings by a combined 10-1 scoreline.
  • All-time Series: RBNY lead 8W - 5L - 2D; RBNY 30 goals scored, NYC 16 goals scored
  • Kickoff: Sunday, November 1 at 7:00 pm ET
  • Watch on: MLS LIVE on ESPN+ in US; MLS LIVE on DAZN in Canada

Match #4: Sporting Kansas City vs. Minnesota United FC

WHO WILL WIN?
SKC win Draw MIN win
20 points 40 points 40 points
Predict the action: Total goals (20 points)
  • Sporting are undefeated in three games (2W-0L-1D) and have posted back-to-back shutouts. During that stretch, goalkeeper Tim Melia set a club record for saves.
  • Sporting have won all five of their matches against Minnesota at Children’s Mercy Park, outscoring the Loons 11-1 in those games.
  • After sitting out their midweek game against the Colorado Rapids because of a "gentleman's agreement," Minnesota will look for Kei Kamara to possibly bag his second goal after a mid-year trade.
  • All-time Series: SKC lead at 6W - 3L - 2D; SKC 17 goals scored, MIN 10 goals scored
  • Kickoff: Sunday, November 1 at 7:30 pm ET

Match #5: Toronto FC vs. Inter Miami CF

WHO WILL WIN?
TOR win Draw MIA win
30 points 40 points 40 points
Predict the action: Who scores first (25 points)
  • Amid a rash of injuries to their starting lineup, Toronto have lost back-to-back matches and been outscored 6-0. The Reds haven’t lost three straight matches since October 2018.
  • An MLS-high 19 of Inter Miami's 21 games have been decided by one goal or drawn. Further, all six of the expansion club's wins this year have been by one goal.
  • All-time Series: First all-time meeting
  • Kickoff: Sunday, November 1 at 7:30 pm ET
  • Watch on: TSN in Canada; MLS LIVE on ESPN+ in US

Match #6: San Jose Earthquakes vs. LAFC

WHO WILL WIN?
SJ win Draw  LAFC win
40 points 40 points 30 points
Predict the action: Time of first goal (25 points)
  • Chris Wondolowski bagged a brace against Real Salt Lake during San Jose's 2-0 win midweek, his 24th career MLS match with multiple goals. Only Landon Donovan (32) has more.
  • Diego Rossi has a league-leading 13 goals on the year, and his latest came in the 9th minute against Houston. It was the fourth time in his MLS career he’s scored in the first 10 minutes.
  • All-time Series: LAFC lead 5W - 1L - 0D; LAFC 21 goals scored, SJ 6 goals scored
  • Kickoff: Sunday, November 1 at 10:30 pm ET

San Diego City Council to hear 'updated' Complete Communities proposal Nov. 9 - pbmonthly.net

nnnindonesia.blogspot.com

The San Diego City Council has scheduled a special online meeting for 11 a.m. Monday, Nov. 9, to review and take action on the city’s Complete Communities proposal, which is touted as a way to “create incentives to build homes near transit, provide more mobility choices and enhance opportunities for places to walk, bike, relax and play.”

An Oct. 27 news release announcing the meeting stated that the city’s efforts to incorporate public input had pushed back the City Council’s consideration of the proposal but improved the plan overall.

“Although we were on track to move forward to City Council in the early summer following several months of public review, we spent the summer and fall incorporating changes into the programs because we wanted to make sure we took the time to fully address comments we received,” city Planning Director Mike Hansen said in the release.

The integrated program has been developed by the San Diego Planning Department and has four components: a Parks Master Plan, a mobility choices initiative, a housing solutions plan and facilities financing.

“After incorporating public input, the housing solutions program now proposes the city’s strongest affordable housing program for mixed-income projects and the city’s most protective anti-displacement and tenant protection policies,” the release stated. “The mobility choices program now proposes even greater focus on delivering infrastructure improvements in communities of concern. The Play Everywhere program now places greater emphasis on land acquisition for new parks and proposes a new urban watershed park typology.”

In the past year, the plan has fallen under scrutiny by several community advisory groups for its perceived lack of public outreach.

The Pacific Beach Planning Group sent a letter to city officials dated Oct. 1 summarizing motions it passed at its September meeting regarding Complete Communities.

The group asked that the city wait to docket the Complete Communities plans “until the housing and infrastructure portions have been fully developed and reviewed by all stakeholders, including community planning groups.” It also requested time for the public to review changes that have been made.

Some are worried that Complete Communities will alter development regulations in coastal areas and increase density through what some opponents have called a “developer’s grab.”

Among other concerns with the proposal, critics say the Parks Master Plan is being rushed through for approval, which would lay the foundation for the housing component. Further, they say the housing component is being justified by a potential transportation element that has not yet been implemented.

An early concern with the plan was that it would not yield one of the stated goals — affordable housing — in the coastal zone and that any loosening of restrictions would actually yield luxury housing.

The Pacific Beach Planning Group’s letter supported increased affordable housing requirements, especially in the coastal zone, where it said “even smaller market-rate units are not ‘affordable’ and smaller units in these areas are more likely to be rented out for short-term rentals instead of for longer-term housing.”

Other critics worried that the plan calls for an increase to the allowable floor area ratio (the square footage of a property in relation to its lot) up to 4.0, whereas the Pacific Beach Planning Group and other coastal community boards want to keep it at or below 2. Some also are concerned about whether the 30-foot building height limit in coastal communities would remain.

The proposal has been heard by City Council subcommittees and affiliated groups since fall 2019. In June, the San Diego Planning Commission voted unanimously to recommend adoption of the Parks Master Plan component with a list of more than 20 items to be clarified.

Also in June, the San Diego Land Use and Housing Committee moved to forward the housing solutions and mobility choices components to the full City Council without a recommendation and to “direct staff to work with community stakeholders ... to try and improve on some of the policies that were of note,” said committee Chairman Chris Ward. The motion passed 3-1, with Councilman Mark Kersey opposed, saying “it just isn’t ready.”

At Land Use and Housing, Councilwoman Jennifer Campbell voiced concern about the time given to review everything and said she “hates to see this move so fast,” though she agreed to forward the proposal to the council.

At the council’s special meeting Nov. 9, members of the public may participate online and provide comment via phone, webform, email or mail. To learn more, go to sandiego.gov and under “City Hall,” click on “Council meetings.”

Teladoc, Livongo complete merger - Modern Healthcare

nnnindonesia.blogspot.com

Teladoc Health on Friday completed a merger with Livongo, a digital health company that helps users manage chronic conditions.

The transaction follows Teladoc shareholders approving the merger agreement Thursday.

The combined company will operate under the name Teladoc Health, maintain Teladoc's headquarters in Purchase, N.Y., and primarily be led by Teladoc's leadership team.

Livongo shareholders received 0.5920 times a share of Teladoc for each Livongo share and $11.33 in cash as part of the merger agreement.

Teladoc has issued roughly 60.3 million shares and paid an estimated $432.1 million in cash, according to Securities and Exchange Commission filings on Friday.

Livongo went public in July of last year. Its common stock stopped trading on the Nasdaq before the market opened Friday. Mountain View, Calif.-based Livongo had been was one of three digital health companies that went public within a week of one another in summer 2019, ending a nearly three-year drought since the last initial public offering of a digital health company.

Teladoc and Livongo first released details of the proposed merger, valued at $18.5 billion, less than three months ago in August.

The companies expect to see 2020 combined revenue of an estimated $1.3 billion and cover 70 million members, according to a presentation shared with investors in August.

As a combined company, Teladoc officials also expect to cross-sell products among their respective customer bases.

Under the merger agreement, Teladoc shareholders will own 58% of the combined company; Livongo shareholders will own 42%, the companies said at the time.

Teladoc's CEO Jason Gorevic will keep his role, leading the combined company.

Livongo's CEO Zane Burke and President Dr. Jennifer Schneider will leave the combined company after the transaction closes, according to an announcement Teladoc filed with the SEC earlier this month.

Teladoc's chairman, David Snow, will lead the new company's board of directors. The new board of directors will comprise eight members of Teladoc's previous board and five members of Livongo's previous board, including Glen Tullman, who had served as Livongo's founder and executive chairman, effective Nov. 19.

Teladoc on Wednesday posted $288.8 million in revenue for this year's third quarter, more than double the $138 million that the company posted during the same period in 2019. The company increased its full-year 2020 guidance, anticipating revenue to surpass $1 billion for the first time; however, Teladoc also reported a sizeable net loss of $35.9 million for the third quarter.

The $35.9 million net loss included $16 million in costs related to the merger with Livongo, according to Teladoc.

Livongo posted $106.1 million revenue for the quarter, up 126.4% year-over-year, and reported having 1,402 clients, up 71.2% year-over-year. Livongo's business model involves working with health systems, health plans and employers as clients, which cover costs of program participation for individual members. Livongo posted a net loss of $25.5 million.

October 30, 2020

SALT LAKE CITY - While they expect voting to go smoothly on Tuesday, Utah elections officials don't expect to see complete results on Election Night - and they're tempering public expectations.

Utah has a long history of mail-in ballots, but with a record number of people eligible to vote this year, it may take a few extra days to count them all and announce the winners.

Derek Brenchley, deputy director of elections for the Utah Lieutenant Governor's Office, said although there are many hotly-contest local, state and national races on the ballot, poll watchers and political operatives will just have to be patient.

"We plan on releasing preliminary election results at 8 p.m. on election night," said Brenchley. "Because we're a vote-by-mail state, we expect ballots to arrive at county clerk offices after Election Day. So, we don't expect election results to be finalized on election night."

In order to be counted, mail-in ballots must be postmarked by Monday, November 2, but can be dropped off in person on Election Day. Utah law does not allow county elections offices to begin counting the votes until Election Day.

As of yesterday, more than 750,000 of Utah's 1.6 million registered voters had completed early ballots. Brenchley said that puts the state on course for a record-breaking turnout.

"The day after the election, we'll get a better sense of how many ballots are outstanding, how many ballots are left to be counted," said Brenchley. "But ballots will ultimately be counted and processed before the counties canvass the election results, and that can happen between seven and 14 days after the election."

In addition to the presidential election, voters will decide dozens of local, county and statewide offices, as well as the fate of two statewide initiatives and seven constitutional amendments.

Voting information is online at 'Vote.Utah.gov.' Results will be posted at 'ElectionResults.Utah.gov.'

Suddenly, These Law Clerks Were More Than Just Colleagues - The New York Times

nnnindonesia.blogspot.com

Shampa Panda and Christopher Bryant both were law clerks in the federal courthouse in Charleston, S.C., when they first met, in 2016, and her frequent visits to his office did not go unnoticed by their co-workers.

“I think Shampa’s a little sweet on you,” Mr. Bryant’s boss told him.

But Mr. Bryant, 35, who both graduated and received a law degree from Duke, was buttoned up and proper, while Ms. Panda, 28, said that her primary interest in him was as a colleague of color in an otherwise very white courthouse. She had graduated from the University of North Carolina, Chapel Hill, and received a law degree from the University of California, Berkeley.

“Here I was coming from Berkeley law, had a strange sounding foreign name and was not passing as anything,” Ms. Panda said, explaining that she saw Mr. Bryant as someone who could help her navigate the city. “My roommate’s dog walker mistook me for the housekeeper.”

Both were working on high-profile cases at the courthouse that involved race. (His was the trial of Dylann Roof, who killed nine people at the Emanuel African Methodist Episcopal Church in Charleston in 2015; hers was the prosecution of Michael Slager, a police officer in North Charleston, S.C., who killed an unarmed Black man, Water Scott, the same year.)

“It felt like all eyes were on us, waiting for us to make a mistake,” Ms. Panda said.

Several years later, in April 2019, both Mr. Bryant and Ms. Panda attended a lecture in Montgomery, Ala., following the publication of a book written by the judge Mr. Bryant had clerked for in Charleston, and the two saw each other in a new light.

Credit...Emma Clark Photography

They had remained in sporadic contact after the conclusion of their Charleston clerkships, but it wasn’t until they were alone together in Montgomery that they saw each other as more than colleagues.

“We had this realization that we’re outside the city of Charleston, where we had our guard up,” Mr. Bryant said. “She was incredibly witty and not quiet and not reserved and almost a different person. It was just us.”

“He was thoughtful and earnest and not doing anything for show, which was something that was surprising for me,” said Ms. Panda.

That evening, the two shared their first kiss, and the following week, they had a formal first date that involved meeting at a Charleston bar, and then walking their bikes together from there to a restaurant.

“I fell in love that night,” said Ms. Panda, adding that falling in love was definitely not in her plan. “I thought, ‘I will do anything that it takes to give this relationship the shot it deserves.’”

She moved to Washington that fall to begin her dream job as a trial lawyer in the environment and natural resources division of the Justice Department. He moved to Washington, too. He is now a litigation associate in the political law group in Washington of Perkins Coie, a Seattle law firm.

On Oct. 17, the couple married in the garden outside the Charleston federal courthouse, with Judge Richard M. Gergel, for whom Mr. Bryant clerked, officiating, and Judge David C. Norton, for whom Ms. Panda had clerked, taking part. The livestream video of their event registered more than 400 views, but the ceremony included just the judges and the couple.

Another judge that had an effect on the course of their relationship was Supreme Court Associate Justice Ruth Bader Ginsburg, who died in mid-September. Her death led to a sudden but sure conviction for Ms. Panda.

“I was watching Chris maneuver this giant treadmill out of our home,” said Ms. Panda, who will use the surname Panda-Bryant. She had bought the equipment thinking she would use it regularly while working from home. She hadn’t, so she was selling it. Mr. Bryant was very patiently looking up, without judgment, how to take apart the treadmill so that it would be easier for its new owners to get it out.

As she watched him, she said: “You know what? Let’s get married. Life is short.”

Tigers Complete Comeback Over Demon Deacons – Clemson Tigers Official Athletics Site - clemsontigers.com

nnnindonesia.blogspot.com

CLEMSON, S.C. – Despite dropping the first and facing set-point twice in game No. 2, the Clemson Volleyball team improved to 2-3 on the season with a four-set victory (22-25, 28-26, 25-20, 25-22) over Wake Forest in Jervey Gym Thursday evening. Four Clemson hitters in Camryn Hannah (15), Cate Long (14), Solei Thomas (12) and Colleen Finney (11) posted double-digit kills. As a team, Clemson registered a season-best hitting percentage of .283.

Box Score (PDF)

A pair of 5-0 runs for the Demon Deacons in the first plagued Clemson early on, but the Tigers dug their heels in late in the second after another Wake Forest late-set push. Four unanswered points by the Demon Deacons gave them set point, 25-24, but Alyssa Deloney, who hit .400 on the night with eight kills, and Mckenna Slavik (48 assists) teamed up for a block at the to break up the Wake run. The Demon Deacons took the lead again on the next play, but three straight Clemson kills sealed the set, 28-26, and evened the match, 1-1.

Anna Renwick, Slavik and Deloney combined for three aces in set No. 3, which was also highlighted by a 6-1 Clemson run to close the set with Deloney behind the line for three straight Tiger points. In the fourth, it was Slavik behind the service line that propelled Clemson to its second win of the season. The sophomore was behind the service line for seven of eight unanswered Clemson points in the middle of the set, which ultimately put the Tigers ahead, 15-11. From there, the two teams traded points as Clemson went on to win the fourth, 25-22, and match, 3-1.

Up next, Clemson (2-3, 2-3 ACC) closes out its fall slate as it hosts Wake Forest (0-5, 0-5 ACC) for Senior Day in Jervey Gym on Friday at 4 p.m. Friday’s contest is set to stream on ACCNX.

Officials hopeful project will start in MN by end of 2020

By Anna Jauhola
HAMILTON, N.D. — Work on the replacement of Line 3 of the crude oil Enbridge pipeline in Minnesota could start as soon as December, according to officials who spoke at an event in Pembina County, N.D., last week.
Enbridge and its contractor partner, Michels, held a celebration event at the Pembina County Fairgrounds in Hamilton, N.D. The 12-mile section of the Line 3 pipe is complete in North Dakota, with the exception of some land restoration. Barry Simonson, director of the Line 3 replacement project in the U.S., said the project went extremely well.
“In terms of the remaining portion of Line 3 in Minnesota, we are poised, once we get all the final permits, to start constructing Line 3 in Minnesota. We’re looking forward to that,” Simonson said. “It’s been a very long process and a very thorough process.
The pipeline has been a source of contention throughout Minnesota over the last few years. It has been heavily objected by many, especially environmental groups. The line route will span 337 miles across Minnesota, starting at the southwest corner of Kittson County. The pipeline replacement sections in Wisconsin, and now North Dakota, are complete.
They remain capped at the Minnesota borders as politicians and private and public officials work toward approving the final permits needed to complete the replacement.
Simonson said Enbridge is still handling the regulatory and environmental permitting process.
“We received the (Public Utilities Commission) permits, they reaffirmed those, in terms of the route permit, the certificate of need and adequacy of the (Environmental Impact Statement),” he said. “This is being appealed by opposition right now. We’re working with the Minnesota DNR, Pollution Control Agency, to finalize their permits.”
He added Enbridge is confident the project’s momentum in North Dakota will move forward the permitting process for Minnesota.
He thanked the residents and businesses in the area for their generous hospitality.
He said he hopes the communities know how important safety, integrity and respect are to Enbridge. Several officials who spoke thanked the surrounding communities for welcoming pipeline personnel, including Hamilton, Cavalier, Walhalla, Drayton, Grafton and Hallock. Several pipeline workers found their homes at campgrounds and hotels over the last few months.
The project alone was a $69 million investment in North Dakota and brought as many as 400 workers into the area.
“Everyone has been great. We’ve heard nothing but positives from workers about how welcoming everyone has been,” said Dave Hodek, spread manager for the North Dakota segment. “So thank you, we definitely appreciate it.”
Enbridge and Michels began construction on the North Dakota segment of pipe in August and officials said it has been the easiest working conditions due to dry weather.
“We’re working in one of the richest agricultural areas in the world here in the Red River Valley,” said Dave Hodek, spread manager for the segment. “It was very important to us to return that land back to the same productivity it had before we came in and installed the pipeline. That’s something we take very seriously. You’ll continue to see us working on that restoration in the next couple of weeks.”
Bob Osborn, senior vice president from Michels, acknowledged the tough situation of local traffic coexisting with pipeline construction traffic, especially during harvest. He also thanked the surrounding communities for their hospitality and patience while construction was in full force.
“With a project like this, there are many new people in the area. We hope that while we are here, we helped out the local communities also by stimulating the local economy,” Osborn said.
Sen. Mark Johnson, R-East Grand Forks, attended the event and said afterward he’s excited by the momentum and hopes it will move into Minnesota as planned at the end of 2020.
“I’ve only heard a couple of concerns (from constituents) about the pipeline, which were well addressed,” he said. “I see a lot of support in our district for the pipeline.”

Corey Brewer explains why Steph Curry is complete 'nightmare' to defend - Yahoo Sports

nnnindonesia.blogspot.com

Brewer explains why Steph is complete 'nightmare' to defend originally appeared on NBC Sports Bayarea

Let's call a spade a spade: Steph Curry is a straight nightmare to defend.

Yeah, I know I'm pointing out the obvious here. But don't take it from me, someone who would have his ankles snapped in four different places if he tried to defend the Warriors star. Let's ask Corey Brewer, a 13-year NBA veteran who has been tasked with trying to contain Curry, LeBron James, James Harden, Kevin Durant and others stars on multiple occasions.

"Guarding Steph Curry is a nightmare," Brewer wrote in a breakdown of the NBA's best offensive players. "When he passes half-court, he can shoot the ball and it's effortless. You have to guard him as soon as he passes half-court, so you have to push up. For me, having some length, I just try to get him to drive to the basket. I want to see Layup Steph Curry rather than Three-Point Steph Curry.

"If Steph starts knocking down threes, you're gonna lose every time. Not only is he gonna make it most of the time, his threes get the crowd into the game and teams can feed off that. From then on, he can do whatever he wants. Once he’s making threes and the crowd is going crazy, we'll try to double-team him. But that’s where his passing comes in - that's when he’s getting everybody else involved. Like I said, he’s a nightmare when he’s making threes.

"He’s also one of the best decoys to ever do it because when Steph Curry's on the court, he gives everybody space. When he gets past half-court, again, you have to guard him. Even if he was just standing there at half-court, I'd probably be right there with him - still guarding him - so those other four guys are gonna be playing with a lot of space."

Download and subscribe to the Runnin' Plays Podcast

So, what's the key to trying to stop Curry from burning down your house every night?

"When I’m guarding him, it’s “please go shoot a layup.” That gives us a chance to win -- because if Steph is shooting threes and making threes, it’s curtains," Brewer writes. "He changed the game with the way he can shoot the ball. That's why all these guys are shooting off the pick-and-rolls, all these guys are shooting threes now. That makes him great. That's why he's a two-time MVP. That's why when people talk about one of the greatest shooters to ever do it, it's probably Steph. He changed the game, a true revolutionary when it comes to shooting that basketball."

Guarding Curry is hard enough in its own right, but when Curry and Durant were on the same court for the Warriors, that was just ridiculous, according to Brewer.

"It was beyond frustrating when Steph and KD were on the same team," Brewer writes. "As if that wasn’t enough, you’d have Klay Thompson on the court too. With all three guys, if they can see the rim, the ball has a chance of going in at a crazy rate. What do you do? You have to basically pick your poison, and you saw what happened. Look at the championships they won. They were almost impossible to guard. They all have high basketball IQs too, which makes it even tougher."

RELATED: Is Crowder or Harkless better fit for Warriors?

Curry, Thompson and the Warriors spent last season recalibrating after five straight trips to the NBA Finals. With Curry, Thompson, Draymond Green and Andrew Wiggins healthy and rested, the Warriors should once again vault back into title contention and should be one of the teams hoping for an earlier start to next season.

Many have assumed the Warriors' dynasty is dead and buried. But Brewer isn't one of them.

"Even without KD, the Warriors will still be good when they get healthy! Klay got hurt and a lot of things happened this year, but they aren’t going anywhere. I'm not gonna say that they had a great run because it's not over yet."

Curry and the Warriors will be back with a vengeance next season, much to the dismay of everyone tasked with containing him.
